Family Law – What Is It?

When people hear the phrase “family law”, what immediately comes to mind is spouses fighting with one another. It seems that most people assume that a “family law attorney” simply divides up assets and debts when a couple is going through a divorce or that a family law attorney simply helps his or her client obtain custody rights for the client’s children.

As a Berks County family law attorney, I can assure you that “family law” is much more complicated than that. It is true that a “family law attorney” must have knowledge about the Pennsylvania Divorce Code, the Pennsylvania Custody Statute, and all relevant case law. However, a good family law attorney must also be well versed in other areas of law as well.

As a Berks County family law attorney, I must not only have a good understanding of the statutes involving equitable distribution, child custody, child support, spousal support, alimony and alimony pendente lite, but also have a good understanding of the tax implications associated with things that often arise in a divorce context; an understanding of the intricacies of a real estate transaction; how to help an individual change his or her name; paternity issues; bankruptcy; and even juvenile delinquency and juvenile dependency.

Most families encountering the justice system usually have issues in which various areas of the law come into play. For example: when a couple is going through a divorce in Berks County, usually the marital residence gets transferred to one spouse or the residence is sold. Then, one spouse often wishes to relocate with the children far away from the other spouse.

Helping Address All Aspects Of Family Law

Often times the Wife wishes to resume her maiden name and many times both spouses realize that, given that they are no longer sharing their incomes, each spouse can no longer afford to maintain the lifestyle that he or she is accustomed to. This often brings with it either or both spouses considering filing for bankruptcy. Finally, when divorcing, if spouses do not learn to communicate with one another post-marriage, often times their children become rebellious and sometimes find themselves involved with the law.
