Trusted Child Relocation Lawyer Guiding You Through Complex Custody Changes

There are many reasons why a custodial parent may need to relocate with the children. They may have received a job offer in another city or state. Perhaps they want to be closer to family for additional support or to pursue educational opportunities elsewhere.

Regardless of the reason, if they are sharing custody with another parent, they must follow a set of legal procedures. My name is Joseph A. Guillama, and I have over 20 years of legal experience helping families navigate complex custody matters in Pennsylvania. As a dedicated advocate for children and a juvenile conflict attorney appointed by Berks County judges, I bring a thorough understanding of how relocation impacts the emotional well-being of children caught in these challenging situations.

The Legal Requirements For Child Relocation In Berks County

Pennsylvania relocation laws require that when a custodial parent plans to move, they must formally notify the other parent in writing. This notification needs to be delivered a minimum of 60 days prior to the planned moving date. If the move is unexpected and cannot be avoided or rescheduled, then they must send the notice within 10 days of learning about the need to relocate.

The notice must include:

  • Detailed information about the new location
  • Reasons for moving
  • A proposal for a revised custody schedule

The noncustodial parent has the right to object to the relocation. If there is an objection, the issue may go to court, where both parents will present their case. Ultimately, the court’s decision will prioritize the child’s best interests. Legal guidance is crucial in navigating this process. As your child relocation lawyer, I can walk you through the rights and responsibilities of each parent.

Factors That Can Determine Your Child’s Relocation Case

Pennsylvania courts evaluate several factors when deciding on relocation requests. This ensures that the move aligns with the child’s best interests. Specifically, they will focus on how parental relocation might affect the child’s welfare and relationships. The court will examine:

  • Reasons for the proposed move: Whether the relocation is necessary due to job opportunities, educational pursuits or family support, as well as the sincerity of these reasons
  • Any objections from the noncustodial parent: This includes the noncustodial parent’s motivations and how the move might impact their relationship with the child
  • The impact on the child’s emotional, educational and social development: How the relocation might affect the child’s stability, including changes in schooling, community and support networks

The court will also assess if the child can still have a good relationship with the parent they won’t be living with after a move. They look at whether they can create a new visitation schedule that works despite the distance. This ensures that the child can still spend quality time with both parents.

Whether you are advocating for or against the relocation, I will help you present a compelling case that keeps your child’s best interests at the center.

Resolving Relocation Disputes Beyond Litigation

If you are facing relocation disputes with your co-parent, there are ways to resolve the issue without going to court. These alternatives often offer a more cooperative and less adversarial approach:

  • Mediation: Where a neutral third party facilitates discussions between parents to reach a mutually agreeable solution
  • Collaborative family law: Both parents and their attorneys work together outside of court to negotiate an agreement, focusing on creative solutions that meet the needs of everyone involved, especially the child

At The Law Offices of Joseph A. Guillama, I guide parents through these processes, helping them explore options that put their child’s well-being at the forefront.
